1. On receipt by us of your completed booking form and £150 deposit we will reserve your holiday. Your booking is taken to be confirmed and accepted in respect of all persons traveling when we dispatch our written confirmation to the person signing the booking form.
2. The person signing the booking form confirms that he/she has the authority of all other persons included in the holiday to make the booking on their behalf and that he/she has read and accepted these booking terms and conditions. The deposit is accepted as part payment towards the total cost of the holiday.
3. The rental period shall commence at 4.00 pm on the first day and finish at 9.00 am on the last day. We will not be obliged to offer the lake or lodge before the time stated and you will not be entitled to remain in occupation after the time stated.
4a). The balance of the cost of the holiday must be paid no later than 10 weeks before departure, or as we may otherwise specify. If you book within 10 weeks of departure you must pay the total cost of your holiday at the time of booking.
b). If unconditional payment of the balance is not received by us by the due date, we reserve the right to cancel your booking, forfeit any deposit made and levy a cancellation charge as though there had been a cancellation in accordance with paragraph 6.
5. The price of your holiday is fully guaranteed.
6. In the event you cancel your confirmed booking, it can only be accepted if it is in writing from the person who signed the booking form, and the following cancellation charges will apply:
More than 10 weeks Deposit only
Less than 10 weeks Total cost
Cancelled holidays will be made available for re-rent through the usual marketing and advertising at the current rate. If we are successful in securing a replacement booking for the cancelled stay, all monies received will be credited back to you minus any administrative costs.
7. A cash security deposit of €200 per party is required on arrival in case of damage to the lodge, its contents or the lake. We reserve the right to check the condition before your departure and refund the deposit or balance due within two weeks, but in most cases immediately.
8. All Passport, Visa and Health Certificate requirements are your responsibility and we accept no responsibility for any delay or expense incurred through any irregularity in your documents. All British holidaymakers should ensure that they hold a Full Ten Year British Passport with a validity of at least 3 months beyond the travel date. Non British subjects should consult their Embassy for information on possible Visa requirements.
9. All individuals within the party traveling must have full Personal and Medical Insurance. It is the party leader who is responsible to ensure that all names on his/her booking form have full cover. By signing our booking form, the party leader confirms that we accept no responsibility for personal injury, inconvenience, loss or damage to personal property however caused.
10. Force Majeure: We will not be liable for loss or delay occasioned by any of the following:- Strikes, Riots, Political Unrest, Hostilities, War or threat of War, Terrorist Activity, Industrial Disputes, Fire, Flood, Technical/Weather problems to transport, Closure of Ports, Weather conditions or any other event (s) beyond our control.
11. Clients are advised to have an appropriate Travel andHoliday Insurance Policy in force for the period of the holiday covering all parties travelling.
12. Whenever possible, any changes to the booking requested after the written confirmation of booking is sent out to you will be accommodated. Dependant upon the nature of the changes, additional costs could be incurred.
13. You agree to be a considerate tenant and to take good care of Lake Mirabelle, the Fishermans Lodge and the surrounding land and to leave them in a clean and tidy condition at the end of the rental period. We reserve the right to make a retention from the security deposit to cover additional cleaning costs if you leave Lake Mirabelle in an unacceptable condition. You also agree not to act in any way which would cause disturbance to those resident in neighbouring properties.
14. You will report to us without delay any defects at Lake Mirabelle or breakdown in the equipment or appliances and arrangements for repair and/or replacement will be made as soon as possible.
15. The holiday booked cannot be assigned. Only the persons shown on the booking form are permitted to travel. Pets are not permitted.
16. Jurisdiction: Signature of the booking form constitutes acceptance of a contract on these terms subject to British Law and the exclusive jurisdiction of the British Courts.
17. Complaints Procedure: If you consider that you have cause for complaint whilst in France, the complaint must be notified to the Fishery Manager on site in the first instance. In most cases, problems can be resolved if this procedure is followed.
All complaints should be made in writing, addressed to Lake Mirabelle, Epran, Chauvigny, 86300, Vienne, France and received as soon as reasonably practical following your return to the U.K.
